CEQA Compliance Statement

The Bush Avenue Pocket Park Project is categorically exempt per CEQA Guidelines 15303(d) and (e), and Section 15304(b) and (f), as it only includes, respectively, new construction of small structures (e.g., play equipment, new water meter, new fence, etc.) and minor alterations of land (e.g., new landscaping, minor trenching and backfill where new surface is restored). The CEQA Notice of Exemption was filed at the Contra Costa County Clerk's Office on December 18, 2021. The Old Town Beautification Project is exempt under the California Environmental Quality Act (CEQA) as a funding action as it is not a project under CEQA nor an activity that may cause a direct or reasonably foreseeable indirect physical environment change pursuant to Public Resources Code section 21080(a) and 14 California Code of Regulations section 15002(d).

 

BACKGROUND

California voters passed the California Drought, Water, Parks, Climate, Coastal Projection, and Outdoor Access for All Act of 2018 (Proposition 68) on June 5, 2018, which authorizes funds for local park rehabilitation, creation, and improvement grants to local governments on a per capita basis. In addition, Assembly Bill 149 (2021) created the Clean California Local Grant Program (CCLGP) of 2021, which is part of the nearly $1.1 billion Clean California initiative that takes direct aim at the continuous trash generation that has overwhelmed the California Department of Transportation (Caltrans) and its partners.

 

On February 22, 2022, through Resolution 2022-026, the City Council (Council) approved the City of San Pablo’s grant application to Caltrans CCLGP for the Old Town Beautification and Bush Avenue Pocket Park Projects. In 2021, the City of San Pablo was issued $196,899 in funds from the Proposition 68 Per Capita Funds (this was not a competitive grant as these funds are issued to all cities on a per capita basis).

 

The Bush Avenue Pocket Park Project is a proposed multi-benefit, community-informed pocket park project that will transform the 1701 Bush Avenue vacant lot into a pocket park with swings, exercise loop, fitness machines, shade structures, other play equipment, and native plants-all elements residents stated they would like to see.

 

On March 1, 2022, the City was notified that the City of San Pablo’s CCLGP grant application was successful and the City had been awarded $377,000. On December 23, 2021, California State Parks approved the City of San Pablo’s Per Capita allocation of Proposition 68 funds in the amount of $196,899. On March 21, 2022, through Resolution 2022-045, the Council accepted and appropriated the funds from the CCLGP grant and the Proposition 68 Per Capita allocation to the Bush Avenue Pocket Park Project (account code 320-0502-43604).

 

On June 1, 2022, staff issued a Request for Proposals (RFP) for Design and Engineering Services for Bush Ave Pocket Park Project (Project #0502). Staff received two submittals and after proposal reviews and interviews and evaluation in accordance with the terms of the RFP, staff determined that the consultant team of Gates + Associates, with sub-consultants CSW, presented the best overall project proposal and are recommended for selection for the requested design and engineering services.

 

Staff is requesting authorization to enter into an agreement with Gates + Associates based on the terms of the RFP and the proposal submitted by Gates + Associates. The term of the agreement will be until the completion of the project which is expected to be January 2024. Staff is requesting authorization for the City Manager to enter into an agreement with Gates + Associates for the above services for the amount of $90,000 and authorization for a 10% contingency to cover additional costs, if any, as authorized by the City Manager, for a total authorization of $99,000.

 

FISCAL IMPACT

The fiscal impact of the contract with Gates and Associates for the proposed services is

$99,000.00 ($90,000.00 contract amount plus a 10% contingency in the amount of $9,000.00). Funding for this contract will be provided by the CCLGP and Proposition 68 Per Capita allocation grant that was accepted and appropriated in Resolution 2022-045.

 

The total estimated project cost for the Bush Avenue Pocket Project is $594,800. Funding for this project is anticipated to come from five different sources:

1-                     CA State Parks Proposition 68 Per Capita in the amount of $196,899;

2-                     Caltrans CCLGP in the amount of $327,300;

3-                     City of San Pablo Street Lighting and Landscape Assessment District in the amount of $32,500 (approved in Resolution 2021-153);

4-                     City of San Pablo Other Revenues in the amount of $34,194 (approved in Resolution 2021-153); and

5-                     Additional funding in the amount of $3,907 to be determined.

 

In addition, upon completion of the Bush Avenue Pocket Park, additional Maintenance Division staff resources will be required for ongoing maintenance of the new facility. The additional maintenance resources are estimated to be $25,000 per year, which includes $5,000 in materials and supplies and 0.2 FTE of staff time in the Maintenance Division.
