CEQA Compliance Statement

This proposed action is not a project under CEQA pursuant to Guidelines Section 15378(b)(2): Continuing administrative or maintenance activities, such as purchases for supplies, personnel-related actions, general policy and procedure making.

 

BACKGROUND

The San Pablo Police Department is not equipped with an armored personnel vehicle for tactical response. These armored vehicles are utilized by law enforcement to provide sufficient cover and concealment when responding to dangerous situations, such as active shooters, hostage rescue, or high-risk search warrant service. Currently the San Pablo Police Department must rely on outside agency assistance for an armored vehicle response.

 

The Defense Reutilization and Marketing Office LESO (1033) Program allows transfer of excess Department of Defense property that might otherwise be destroyed to law enforcement agencies across the United States and its territories. Beginning in 1997, Congress passed the National Defense Authorization Act which allows all law enforcement agencies to acquire property for bona fide law enforcement purposes.

 

Over 8,000 federal and state law enforcement agencies from all 50 states and the U.S. territories participate in the program. The San Pablo Police Department has participated in this program in the past for the acquisition of firearms and rifles.

 

In 2008, the Hercules Police Department acquired an armored personnel carrier (Dragoon-300) through the LESO 1033-program. The Hercules Police Department is prepared to release the armored vehicle to the San Pablo Police Department at no cost through the 1033 Program.

 

The acquisition of this vehicle allows staff to prepare for high-risk response and the continuing evolution of SWAT Operations to incorporate “surround and callout” tactics, when appropriate, for peaceful resolutions.

 

 

 

Public Safety Standing Committee Review

The Office of the Police Chief presented the potential acquisition of the armored personnel vehicle to the Public Safety Standing Committee (Cruz; Pabon-Alvarado) for review and consideration on December 4, 2019. The Committee voted to receive the presentation and recommended it be forwarded to City Council for formal consideration.

 

FISCAL IMPACT

There is no cost for the acquisition of the armored vehicle through the LESO 1033 Program. There are expected ongoing maintenance costs which will be incorporated within the existing vehicle maintenance program. It should be noted that staff inspected the vehicle at the Hercules Police Department and found it to be in good working condition with minimal use over the past ten years.
