CEQA Compliance Statement
The project is exempt under the California Environmental Quality Act as a funding action, which is not a project under the California Environmental Quality Act (CEQA), as it is not an activity that may cause a direct or reasonably foreseeable indirect physical environment change pursuant to Public Resources Code section 21080(a) and 14 California Code of Regulations section 15002(d). Further, to the extent that funds are eventually used for a capital project, such project would be exempt; Section 15301 of the CEQA Regulations, Existing Facilities, provides “Class 1 consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination.” This includes existing facilities such as publicly-owned utilities used to provide electric power, natural gas, sewerage, or other public utility services. Section 15309 of the CEQA Regulations exempts inspections.
BACKGROUND
Pursuant to Resolution 2019-017 adopted on February 4, 2019, $176,599 in FY 2018/19 General Fund Designated Reserves was set aside for Hillside Stabilization & Geo-Tech Studies/Improvements. In May 2019, this designated amount was appropriated to the San Pablo Dam Road Hillside Stabilization Project through Resolution 2019-061 in anticipation of assessment and preliminary design to stabilize San Pablo Dam Road between Amador Street and the Princeton Plaza Shopping Center.
A portion of this money should have been designated to go into a separate project intended for the long-term monitoring of the hillside between Hillcrest Drive and Princeton Plaza. This hillside has historically experienced slide activity. Repairs of portions of the hillside have occurred over a number of decades, and specialized testing instruments have been installed to monitor any ongoing slope movement and hydraulic soil pressures. This funding will assist with regular monitoring of the hillside, readings taken by the installed instruments, and equipment replacement and repairs as necessary.
To date, roughly $10,000 of the $176,599 has been utilized toward geotechnical expenses to monitor the San Pablo Dam Road Hillside. Given the current need for hillside monitoring behind Princeton Plaza and per the proposal submitted by on-call geotechnical consultant Miller Pacific Engineering Group, city staff requests to reallocate $20,000 from the San Pablo Dam Road Hillside Stabilization Project to the Princeton Plaza Project.
