CEQA Compliance Statement

This proposed action is not a project under CEQA pursuant to Guidelines Section 15378(b)(5): Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment, but if deemed a project, then under CEQA Guidelines § 15061(b)(3), in that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

 

BACKGROUND

On November 20, 2017, the City Council adopted Resolution #2017-214, authorizing the surplus and disposal of (66) VieVu LE4 body-worn cameras (BWC), equipment, and hardware pursuant to San Pablo Municipal Code 3.16.120. In March 2018, the City of Grover Beach Police Department agreed to purchase the surplus of VieVu cameras and equipment for $5,000. As one of the few remaining police agencies to still use the LE4 model, this procurement will allow Grover Beach Police Department to sustain their BWC program for the foreseeable future.

 

On April 16, 2018, the City Council adopted Resolution #2018-060, authorizing the procurement of Vigilant ALPR (automated license plate reader) cameras to replace the antiquated 3M camera equipment previously installed. The 3M camera equipment which included 16 ALPR cameras and hardware, were subsequently removed from the installed locations. In January 2019, the City of Piedmont Police Department expressed interest in procuring our inventory of 3M ALPR cameras to support their surveillance technological infrastructure. Subsequently a PIPS (formerly known as 3M) engineer retrieved our inventory to check functionality and confirmed only nine of the 16 cameras were operational. The City of Piedmont Police Department has agreed to purchase the remaining inventory for $8,500.00 and be responsible for the e-waste of the remaining nonfunctional cameras.

 

There is nominal value in maintaining the ALPR cameras. The Police Department, therefore, desires to declare the listed equipment as surplus property and dispose of it pursuant to San Pablo Municipal Code section 3.16.120.

 

The San Pablo Municipal Code 3.16.120 states: “All using departments shall submit to the purchasing officer, at such times and in such form as he shall prescribe, reports showing all supplies and equipment which are no longer used or which have become obsolete or worn out. The purchasing officer shall have authority to exchange or trade in all such supplies, equipment and materials; to sell by public auction, sealed bid, or agreement with other public agencies; or sell by direct negotiated agreement, or on a consignment basis. In the event the purchasing officer determines that any such obsolete or surplus property has no salvage value, he may dispose of it as he deems advisable.”

 

FISCAL IMPACT

The sales of the 3M cameras and VieVu BWC’s will generate $13,500 in General Fund revenue to the City and will be posted to a Police Department revenue account (100-2110-39202). The Police Department desires to appropriate those funds to an expendable account in the Police Department’s General fund budget (100-2110-43600). These funds will be utilized to fund much needed technological enhancements and computer procurements for the Report Writing room within the Police Department facility.
