BACKGROUND

Since July 2017, the West Contra Costa Integrated Waste Management Joint Powers Authority (RecycleMore JPA) Board of Directors solicited the assistance of the five West County City Managers to recommend a Joint Exercise of Powers Agreement (JEPA) amendment framework to streamline RecycleMore’s regional coordination and program management of solid waste, recycling, household hazardous waste, and regulatory reporting programs to the State of California on behalf of all JPA member agencies.

 

Over the last 18-month period, there has been substantial effort made by all five City Managers to reach consensus on a recommended JEPA amendment framework that attempted to address all JPA related operational issues (i.e. core services, reserve fund disbursement, provisions for member agency withdrawal, and including changes to Board governance and representation, etc.).  A consensus was successfully reached collaboratively by all five City Managers in August 2018.

 

Unfortunately, in December 2018, the City of Richmond under a new administration, proposed new changes to the August 2018 City Manager recommended JEPA amendment framework.  The City of San Pablo does not agree with the proposed changes from the City of Richmond as reviewed in a recent meeting held between all five City Managers on January 7, 2019.

 

The Recyclemore JPA Board of Directors is scheduled to meet on January 24, 2019 to receive an update from Stan Hakes, RecycleMore JPA Executive Director, on the JEPA amendment process. In preparation for this RecycleMore JPA Board update, the City Manager has outlined a number of concerns relative to the City of San Pablo’s current position on the JEPA amendment process, and requires the City Council to acknowledge and ratify the letter transmitted on January 9, 2019 to Mr. Hakes (See Attachment). 

 

 

Additionally, for your reference, the City Managers of Hercules and Pinole, other small member agencies on the RecycleMore JPA Board, have transmitted similar status letters to Mr. Hakes expressing their City’s current position with regard to the JEPA amendment process (See Attachments).

 

The City Manager remains open to moving the JEPA amendment framework and process forward, but recommends that it be done in close alignment with the provisions agreed upon during August 2018 by all five City Managers.
