Infrastructure - Capital Improvement Projects - Rumrill Complete Streets Corridor Mobility Plan (455.2.11) and Wildcat Creek Restoration behind Plaza San Pablo (455.2.16) are adopted policy items under the FY 2018-21 City Council Priority Workplan, effective November 1, 2017.
CEQA Compliance Statement
The Rumrill Boulevard Complete Streets project is categorically exempt under the California Environmental Quality Act, Section 15301, Existing Facilities (Class 1) of the CEQA Regulations, on the basis that the project involves repair and minor alteration to the existing public streets, sidewalks, gutters and similar facilities. The Notice of Exemption was filed and recorded with the Contra Costa County Clerk on January 7, 2018. Since the project is also receiving federal funding the project was also determined to categorically exempt under the National Environmental Policy Act (NEPA), Section 23 CFR 771.117(c): activity(c)(3). The Notice of Exemption for NEPA was filed on March 14, 2018 by the California Department of Transportation (Caltrans).
The Wildcat Creek Restoration and Greenway Trail project is categorically exempt under the California Environmental Quality Act, Section 15333, Small Habitat Restoration Projects of the CEQA Regulations. The Notice of Exemption was filed and recorded with the Contra Costa County Clerk on May 25, 2018.
BACKGROUND
The Metropolitan Transportation Commission has previously allocated $56.1 million in federal funds to the Contra Costa Transportation Authority (CCTA) for a Coordinated Call for Projects. On December 9, 2016, staff submitted applications for Phase II - Rumrill Boulevard Complete Streets and Plaza San Pablo Greenway Trail Projects. The scope of the Plaza San Pablo Greenway Trail has been increased and has been renamed the Wildcat Creek Restoration and Greenway Trail project in City records, but CCTA’s records, and the funding agreement, reflect the original project name.
On June 7, 2017, CCTA’s Planning Committee approved Measure J - PBTF and TLC Program funding for each submitted project application as follows:
1) Measure J Transportation for Livable Communities (TLC). This grant funds projects that support mixed-use, walkable and transit-accessible development as well as projects that encourage walking and bicycling. The City of San Pablo was awarded a total amount of $280,000 in TLC funding for the Plaza San Pablo Greenway Trail.
2) Measure J Pedestrian, Bicycle and Trail Facilities (PBTF). This grant funds construction of bicycle and pedestrian projects including regional trails throughout Contra Costa County. The City of San Pablo was awarded a total amount of $2,000,000 in PBTF funding for the Plaza San Pablo Greenway Trail ($1,000,000) and Phase II - Rumrill Boulevard Complete Streets ($1,000,000)
To receive funding appropriation, project sponsors must first enter into a cooperative funding agreement with the Authority (CCTA) for the funding program from which the project sponsor will receive funding. The cooperative agreement spells out the responsibilities of the Authority and the project sponsor related to project development, delivery and invoicing, as presented in Attachment A. Separate agreements are required for the Measure J TLC and PBTF funding programs. In September 2012, City Council adopted Resolution # 2012-136 entering into Agreement No. 12W.05 for Measure J-TLC Program funding.
FISCAL IMPACT
The fiscal impact of this Council item is to accept and appropriate grant fund revenue as follows:
(1) Wildcat Creek Restoration and Greenway Trail
The Wildcat Creek Restoration and Greenway Trail total project cost is $4,400,000. Measure J/PBTF grant funds in the amount of $1,000,000 and Measure J/TLC grant funds in the amount of $280,000 need to be accepted and appropriated to Wildcat Creek Restoration and Greenway Trail Project (320-3203-43600-WCC-TRL). A total of $178,532 in grant matching funds is needed. Grant match funds in the amount of $100,000 are available for this project as part of the FY 2017/18 CIP budget (funds which were approved and rolled over from FY 15/16) and $78,532 will need to be budgeted, accepted and/or appropriated by the FY 2019/20 to the CIP budget for this project.
(2) Rumrill Boulevard Complete Streets (Phase II)
The Rumrill Boulevard Complete Streets (Phase II) Project total project cost is $14,300,000. Measure J/PBTF grant funds in the amount of $1,000,000 need to be accepted and appropriated to Rumrill Boulevard Complete Streets Project (320-3203-43600-RUM-CST). A total of $118,000 in grant matching funds will need to be budgeted, accepted and/or appropriated by FY 2019/20 to the CIP budget for this project.
