CEQA Compliance Statement

This proposed action is not a project under CEQA pursuant to Guidelines Section 15378(b)(5): Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. If a project, then the project is exempt from the provisions of the California Environmental Quality Act, (CEQA), under CEQA Guidelines § 15061(b)(3), in that it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.

 

BACKGROUND

On November 7, 2017, the Public Safety Standing Committee received a presentation on the AXON equipment and software as well its implementation. The Committee voted to receive the presentation and recommended this item be forwarded to the City Council for approval.

 

On November 21, 2017, the City Council approved a five-year contract with AXON ENTERPRISE INC. to outfit the Police Department with 55 body worn cameras (BWC) using integrated cloud-based storage. This highly successful program captures and retains footage of on-duty police contacts with the public made by members of the San Pablo Police Department. AXON integrated solutions offers additional enhancements for our BWC program designed to increase officer safety, reduce instances of non-capture events and integrate capture and storage of video from sources other than body worn cameras.

 

Staff recommends purchasing the following equipment to meet the needs of our existing program:

 

(A) The AXON Fleet Unlimited package will equip the Police Department’s existing patrol cars with digital cameras that automatically activate when the overhead emergency lights are initiated. The integrated system simultaneously activates the officer’s body worn camera as well. Each camera documents traffic stops in their entirety and uploads the data into our existing cloud-based infrastructure. The cost of this integrated system is $157,566 and includes one upgrade, tax, license, shipping, installation, and an equipment warranty for a period of five years. 

 

(B) The AXON Signal Sidearm package incorporates a device into our existing equipment that automatically activates a body worn camera whenever a firearm is removed from its holster. Automatic body worn camera activation in rapidly evolving, high risk critical situations promotes officer safety, reduces risk and injury and can be valuable in both prosecutorial and civil litigation environments. This system will increase our capture rate of incidents where the criticality and nature of the situation doesn't allow for the officer to manually activate their camera. The cost of this integrated system is $33,930 and includes one upgrade, tax, license, shipping, and an equipment warranty for a period of five years.

 

(C) The AXON Integrated Security System incorporates enhanced technology cameras inside the Police Department that replaces our existing outdated technology. Footage captured inside the Police Department will automatically upload into our existing cloud-based infrastructure. The cost of the integrated system is $33,838 and includes one upgrade, tax, license, shipping, installation, and an equipment warranty for a period of five years. 

 

The Department currently uses the AXON X26 Taser and the AXON Body Worn Camera System with cloud-based technology which is fully compatible with the AXON Integrated System components listed, affording all the benefits of interoperability.  Therefore, acquisition pursuant to the specialized services and equipment exception and sole source justification are met because the goods and services required to satisfy the Department’s specific technological needs and product integration are only manufactured and available for purchase from AXON, and AXON is the sole developer and vendor of the Police Department’s cloud-based body worn camera storage management system.

 

The Police Department expects to realize approximately $1,000,000 in salary savings at the conclusion of FY 2017/18. Salary savings in the amount of the purchase will be appropriated from the Police Department salary account (100-2110-41000) into the Police Department professional services account (100-2110-43600) to complete this purchase.

 

FISCAL IMPACT

The total cost for the three systems including one upgrade, tax, license, shipping, and equipment warranty for a period of five years is $225,334. Of this amount, $225,334 will be transferred from the FY 2017/18 Police Department salary account (100-2110-41000) into the Police Department professional services account (100-2110-43600), such that no new appropriations are needed. This purchase agreement is good for five years. At the conclusion of five years, the City will negotiate new licensing fees with AXON.
