FY 2016-17 Council Priority Workplan

The Street Lighting and Landscape Assessment District provides funding for Infrastructure:  Park and Median Island Maintenance, which is an adopted policy item under the FY 2016-17 City Council Priority Workplan.

 

CEQA Compliance Statement

CEQA does not apply because creation of government funding mechanisms or similar fiscal activities are not a project pursuant to 14 Cal Code of Regulations section 15378(b)(4) and further that maintenance projects are exempt under 14 Cal. Code of Regulations section 15301.

 

BACKGROUND

The San Pablo Street Lighting and Landscape Assessment District No. 1982-1 was formed in August of 1982.  The boundary of this District is identical to the incorporated limits of the City of San Pablo. This resolution preliminarily approves the Engineer's Report, which describes the improvements, gives an estimate of the total cost of the improvements, contains a diagram of the District, and gives an estimate of the annual assessment for Fiscal Year 2016/17. This resolution also sets a date for a Public Hearing for July 5, 2016 and directs the publication of notice in accordance with the requirements of the Landscaping and Lighting Act of 1972 (Streets & Highways Code Section 22500).

 

The Engineer's Report has been prepared by the City's Consultant, LCC Engineering & Surveying, Inc. (LCC), and filed with the City Clerk.  The breakdown of costs included in the report is consistent with the Fiscal Year 2016/17 Street Lighting and Landscaping Assessment District budget.  The Introduction to the Engineer’s Report is attached (See Exhibit A).  The full report, including the Assessment Roll, which lists the amount of the proposed assessment on each parcel of land within the District and the Assessment Diagram are on file in the office of the City Clerk. There is no increase proposed in the assessment rate.  

 

The proposed expenditure of Street Lighting and Landscape Assessment District funds recommended for FY 2016/17 is $1,327,946, as shown in Exhibit B, “Table 2, Estimate of Cost” from the Engineer’s Report. The increased cost is primarily associated with:  lighting enhancements including upgrading exterior lighting for all City facilities; enhancement of lighting on El Portal (West) and retrofitting of City street lights to LED; median island improvements; and street tree maintenance/trimming.  The estimated FY 2016/17 assessment revenue is $843,281.  Additional funding is required from another source (General Fund - $357,787) to complete funding of the FY 2016/17 Street Lighting and Landscaping (Fund 2110) budget. 

 

During development of the FY 2015-17 Biennial Budget, $374,000 in utility expenses was moved from the Street Lighting and Landscaping Budget to the citywide Multi-Departmental Budget for utilities for both FY 2015/16 and 2016/17. However, City Council approved moving the FY 2015/16 funding amount back into the District budget on August 3, 2015 by Resolution 2015-137 to ensure that the District had sufficient funding to operate throughout the fiscal year.

 

The action proposed in this report would transfer appropriations of $357,787 from the General Fund (100-8000-44400) back to the Street Lighting and Landscaping Assessment District budget (205-2110-44400) for the same purpose of ensuring sufficient funding for the entirety of the fiscal year. 

 

It should be noted that this action preliminarily approves the Engineer's Report and sets the date for a public hearing on the proposed assessment.  The City Council may change the proposed assessment (reduction only) during its budget review process. In order for assessments to be collected within the existing District for the 2016/17 fiscal year, however, the Council must conduct a public hearing and order that the Assessment and Diagram be filed with the County Auditor not later than August 10, 2016.

 

FISCAL IMPACT

The total of the approved FY 2016/17 budget for Street Lighting and Landscaping Assessment District-funded units exceeds available Assessment District revenues and will require supplemental funding in the amount of $357,787 from the utility account in the General Fund Multi-Departmental budget (100-8000-44400).  According to the report of the Engineer, a portion of the supplemental funding serves to offset any General Benefit, i.e. benefits that are not special to the assessed properties that may be received from the District improvements.
