REQUESTED ACTION
This item is an appeal of the decision of the Planning Commission to deny a Conditional Use Permit (through a vote of 3 ayes, 1 no, and 1 abstention) for a retail cannabis use at an existing commercial building located in the Mixed Use Center North District in the San Pablo Avenue Specific Plan (SP-2) at 14501 San Pablo Avenue, APN: 413-352-017.
Per San Pablo Zoning Code Section 17.16.080, an action of the Planning Commission may be appealed to the City Council by any interested person within 10 days of the decision being issued. The applicant filed an appeal and paid the applicable fee on February 26, 2026, and an appeal hearing was scheduled for the City Council meeting on April 6, 2026.
The appeal is considered a de novo (new) hearing. The City Council should consider the application for the Conditional Use Permit on its own; it does not need to rely on or consider any findings made by the Planning Commission.
