FY 2018-2021 Council Priority Workplan Compliance Statement

Reduce promotion of unhealthy tobacco products to youth, such as prohibiting the sale of flavored tobacco products, and the number of stores that seek these products near San Pablo schools is an adopted policy or program under the FY 2018-21 Council Priority Workplan, effective November 1, 2017, as amended by Resolution 2018-024 adopted by the City Council on February 20, 2018.

BACKGROUND

 

Proposed City Council Workplan Amendment

At the February 20, 2018 regular City Council meeting, the San Pablo City Council adopted Resolution #2018-024 which added the following policy to the FY 2018-2021 Council Priority Workplan (See Attachment), as follows:

 

POLICY AREA:  SERVICES FOR FAMILIES, SENIORS AND YOUTH

Add:   Policy to reduce promotion of unhealthy tobacco products to youth, such as prohibiting the sale of flavored tobacco products, and the number of stores that seek these products near San Pablo schools

 

Additionally, as part of the City Council’s deliberation, the City Council also directed that a presentation from a representative from Bay Area Community Resources be scheduled at a future City Council regular meeting to provide an overview of the health and safety dangers of flavored tobacco products being sold to youth at retail establishments in close proximity to San Pablo schools (See Attachment).  This presentation was initially available at the February 20, 2018 City Council meeting for information purposes but will now be officially presented and reviewed by the City Council for formal policy direction.

 

 

Any future policies being considered by the City Council must take into consideration the City’s existing zoning regulations (Section 17.62.180 of the San Pablo Zoning Ordinance) which establishes site planning, development and operation standards for smoke shop retailers.  Moreover, draft policies for future City Council consideration may be developed by City staff in conjunction with a policy recommendation from the City Council Public Safety Standing Committee.  If any policies result in any future modification of the City’s zoning ordinance, then the City’s Planning Commission will be required to review and make a recommendation on any such modifications to the City’s Zoning Ordinance prior to any formal consideration by the City Council.

 

Therefore, the City Council could consider the following recommendations by minute action vote, including but not limited to the following:

 

1)                     Direct staff to explore and research appropriate and applicable policies to further protect youth from the availability and sale of flavored tobacco products especially near local schools; and

 

2)                     Once developed, bring forward to City Council for formal consideration with a policy recommendation(s) from the Public Safety Standing Committee (Calloway/Morris); and/or

 

3)                     If any recommendations include proposed modifications to the City’s Zoning Ordinance, then such modifications shall be drafted as an ordinance amendment for Planning Commission review and recommendation prior to any formal consideration by the City Council.
