FY 2023-2025 Council Priority Workplan Compliance Statements:
Item 202: Develop and Implement Long-Term Environmental Stewardship Goals is an adopted policy item under the FY 2023-25 Council Priority Workplan, effective May 1, 2023.
BACKGROUND
As a result of the 1987 amendments to the Federal Clean Water Act, the Environmental Protection Agency was given the authority to regulate stormwater discharges from municipal storm drains under the National Pollutant Discharge Elimination System (NPDES) regulations. The objective of the NPDES program is to improve water quality and creek health through the reduction and/or elimination of polluted runoff. The City of San Pablo’s NPDES Permit (No. CAS612008) was updated and reissued on July 1, 2022. This new permit (MRP 3.0) has strict compliance requirements for trash reduction to creeks through the City’s storm drain network, known as provision C.10.
To comply with these new requirements, the City developed the City of San Pablo Trash Management Plan (Trash Plan) which was submitted to the Regional Water Quality Control Board in September 2023 and updated in October 2024. The Trash Plan outlines actions that the City will take and a schedule of implementation to meet the 100% reduction or “no trash to the creeks” requirement by June 30, 2025.
The City must now implement the major programs and activities described in the Trash Plan. The major items outlined in the Trash Plan are:
1. Develop a Private Land Drainage Ordinance to require private lands that are directly plumbed to the City’s storm drain system to maintain a low trash generating site.
2. Install Full Trash Capture devices throughout the City. (Completed in October 2024)
3. Delineate and map the drainage areas associated with the newly installed full trash capture systems.
4. Implement programs that promote proper disposal of trash and enhance on-land clean-up events.
5. Perform On Land Visual Trash Assessments (OVTAs) to ensure continued compliance with NPDES C.10.
The City received a quote from EOA, Inc. to assist the City in developing a Private Land Drainage Ordinance (Item 1), delineating and mapping drainage areas for newly installed full trash capture systems (Item 3), OVTA support (Item 4), and general technical support. Staff adhered to the City’s Purchasing and Payables Guidelines regarding professional services contracts for this quote and agreement.
This City Council item is to authorize the City Manager, or designee, to enter into an agreement with EOA, Inc. The term of the agreement will be through completion of the project which is expected to be December 2025. Staff is requesting authorization for the City Manager, or designee, to execute an agreement with EOA, Inc. for the above-referenced services in the amount of $98,994.
FISCAL IMPACT
The total contract amount with EOA, Inc. for Trash Load Reduction and NPDES Compliance Services is $98,994. Funding for this contract will come from the remaining budget in Project Code 0907 in the amount of $47,952 (Resolution 2023-082) and by appropriating funds from the Solid Waste Operating Budget as follows:
