BACKGROUND
The City of San Pablo is eligible to apply and receive State and Federal funding from the California Department of Transportation, also known as Caltrans. Eligible expenditures include, but are not limited to, planning, environmental, preliminary engineering, construction engineering, and construction costs for infrastructure projects. When funding is awarded to the City, the City is responsible for the execution of State and Federally funded projects.
Per 23 CFR 172.5(b)(1), subrecipients of State and Federal funding are required to adopt written policies and procedures prescribed by the awarding State Transportation Agency for the procurement, management, and administration of engineering and design related consultant services (A&E Services) in accordance with applicable Federal and State laws and regulations. Caltrans has developed the Local Assistance Procedures Manual (LAPM) to navigate through the Federal Highway Administration (FHWA) process. Chapter 10- Consultant Selection in the LAPM (Exhibit A) sets forth policies and procedures for procurements and management of contracts for engineering and design related consultant services contracts for projects that are funded in whole or in part with Federal-Aid Highway Program funding as specified in 23 U.S.C. 106(g)(4)(A).
Through its Purchasing Policy, the City addresses policies and procedures for procurement of contracted consulting services. To ensure compliance with Federal and State laws and regulations and to maintain eligibility for federal and state reimbursement, City staff recommends the adoption of Caltrans’ Local Assistance Procedures Manual (LAPM) Chapter 10- Consultant Selection, and any updates thereto, for procurements of engineering and design related services for state and federally funded projects.
FISCAL IMPACT
There is no direct expenditure of funds associated with this action. Rather, this item seeks to adopt procurement policies for engineering and design related consulting services contracts for state and federally funded projects through the California Department of Transportation. The adoption of said policies will allow the City to maintain eligibility for federal and state reimbursements for current and future grant funded projects. Currently, the City has seven projects with federal and state funds for which it is and will be receiving reimbursements.
