FY 2025-27 Council Priority Workplan Compliance Statements:

Item 202: Develop and Implement Long-Term Environmental Stewardship goals is a major policy goal contained in the FY 2025-27 City Council Priority Workplan, adopted on April 7, 2025. 

 

BACKGROUND

Solid waste services, which include garbage, recycling, and green waste curbside collection and post-collection processing and disposal, are provided by Republic Services for West County municipalities.  There are two (2) separate contracts for solid waste and recycling programs and services for the City of San Pablo, as follows:

 

1.                     Collection Services:  This includes the curbside (or on-property) collection of solid waste material; and

 

2.                     Post-collection Services:  This includes the processing of solid waste material after collection.  Post-collection services involve either the disposal of non-reusable solid waste material or the processing of this material to be used in after-market products (such as compost or recycled products).

 

Collection Services

The City of San Pablo has had a Franchise-Collection Agreement with Richmond Sanitary Services, Inc. (RSS), a subsidiary of Republic Services, Inc., since 1986, which expires on June 30, 2025.  The City of San Pablo has direct control over the Collection Service program and began an RFP solicitation process for a new agreement in May 2023, which was completed in November 2024.  Through Resolution 2024-140 the City Council approved Republic Services as the franchised hauler for the City with a new contract to begin on July 1, 2025. Post-Collection Agreement

The City of San Pablo is a member of the West Contra Costa Integrated Waste Management Authority (Authority), also known as RecycleMore, which is comprised of San Pablo, El Cerrito, Richmond, Pinole, Hercules, and parts of Unincorporated Contra Costa County.  On behalf of its member agencies, RecycleMore has an agreement with Republic Services/RSS for the post-collection processing and disposal of solid waste. This Post-Collection Agreement has been in effect since 2013 and expires on June 30, 2025.

 

On May 15, 2023, through Resolution 2023-079, the San Pablo City Council directed the San Pablo RecycleMore Board Member representative (Councilmember Xavier) to direct RecycleMore staff to work collaboratively with staff from all member agencies on the development of an open and competitive bidding process for the Post-Collection Agreement.

 

In October 2024, RecycleMore staff released a Request for Proposals (RFP) for Post-Collection Services for the RecycleMore service area.  RecycleMore received one bid (Republic Services), has reviewed the proposal, and has formally requested authorization to begin negotiations with the bidder. According to Section 5.4 of the RecycleMore Joint Exercise of Power Agreement (JEPA), each member agency must provide written authorization for RecycleMore to do the following:

                     Section 5.4 (f) - Enter into a regional Post-Collection processing agreement or Post-Collection franchise agreement.

                     Section 5.4 (g) - Adopt resolutions and ordinances necessary to carry out the purposes of the Post-Collection agreement.

                     Section 5.4 (h) - Direct all solid waste collected by the City’s contractor, per its Collection Agreement, to the Approved Facility for the period beginning in 2025 until the end of the new regional Post-Collection Agreement.

 

Staff Recommendation

City staff recommends City Council authorize RecycleMore to move forward with negotiations of a Post-Collection Agreement and for the Authority to exercise the agency's powers under JEPA sections 5.4(f), 5.4(g), and 5.4(h) as identified above.  Staff also recommends the City Manager, or designee, be authorized to execute any and all documents necessary to effectuate this authorization.

 

FISCAL IMPACT

The proposed action has no direct impact on the City of San Pablo's adopted budget.  RecycleMore is independently funded through solid waste service fees.
