CEQA: This project was assessed and determined to be Categorically Exempt under CEQA Section 15301(b), which covers the operation, repair, and maintenance of Class 1 existing publicly owned utility facilities. The CEQA Notice of Exemption (NOE) will be filed at the Contra Costa County Clerk’s Office.

Item 513 - Continue Efforts to Support Hillside Protection and Sustain City Drainage Infrastructure is a major policy goal contained in the FY 2025-27 City Council Priority Workplan, adopted on April 7, 2025.
BACKGROUND
On October 22, 2024, City staff responded to a call regarding a sinkhole forming in the backyard of the residence at 1850 Mesa Buena Avenue. City staff conducted a field inspection and determined the necessity of a Closed-Circuit Television (CCTV) inspection of the adjacent storm drain that runs through the property. City staff contacted multiple contractors to conduct a CCTV inspection of the pipe. The inspection took place on January 21, 2025, and the footage revealed that the storm drain was damaged near the sinkhole's location. The existing storm drainage system dates back to the subdivision's construction, and the condition of the pipe has deteriorated over time.
In February 2025, the City began contacting contractors to repair the pipe using a trenchless method. During a field visit on March 4, 2025, City staff observed that the sinkhole had increased in size since the prior inspection. City staff believes that heavy winter storms have suddenly caused the erosion to occur at a more rapid pace than previously anticipated. Due to the sinkhole’s location directly adjacent to a walkway and backdoor of a single-family home, City staff recommended taking emergency action to excavate and replace the damaged storm pipe. Staff believes that the pipe needs to be repaired as soon as possible before it causes potential additional property damage.
The City has two existing contracts with construction companies that are capable of performing emergency storm drain repair work. City staff contacted both companies and received quotes to perform an emergency repair. Both quotes are summarized below.

Due to the need for an immediate response to repair the pipe and fix the sinkhole, pursuant to Public Contract Code Section 22050 and San Pablo Municipal Code Section 3.16.110.D, the City Manager authorized staff to procure equipment, supplies, and services necessary to safeguard the property at 1850 Mesa Buena Avenue and, as necessary, other adjacent properties, without competitive bidding insofar as compliance with the normal bidding process will cause undue delay.
On March 27, 2025, the City obtained right-of-entry agreements from the property owner at 1850 Mesa Buena and the adjacent property owner at 1860 Mesa Buena. On April 8, 2025, City staff executed a contract with contractor Golden Bay Construction, Inc. The contractor will begin construction as soon as the material is procured.
Staff is requesting that the City Council ratify, by four-fifths vote, prior emergency actions taken by the City Manager, including the execution of a contract with Golden Bay Construction in the amount of $52,360. In addition, staff is requesting authorization of the City Council, by four-fifths vote, a continuation of the emergency procurement actions undertaken by the City Manager, all pursuant to Public Contract Code Section 22050 and San Pablo Municipal Code Section 3.16.110.a for the storm drain repair work at 1850 Mesa Buena.
FISCAL IMPACT
Public Works can absorb the emergency repair costs through its existing CIP budget. The fiscal impact is outlined in the table below.
