Background
On January 7, 2013, City Council adopted Resolution 2013-002 which approved all City Council Assignments for Calendar Year 2013. Contained in this approval was the establishment of an Alternative Governmental Services and Structures Ad-Hoc Subcommittee (Calloway/Kinney), which subsequently met with the City Manager, former City Attorney and Special Legal Counsel Julian Gross on the development of a Local Hiring Ordinance policy for City-initiated public works projects, as well as project labor agreement arrangements.
A proposed Local Hiring Ordinance for City public works projects was initially developed and brought forward for discussion with the Ad-Hoc Subcommittee members and City Council consideration in February 2013. Following these discussions, and reaction from the Contra Costa Labor Trades Council and American Building and Contractors’ Association, the matter was not pursued further and the Subcommittee disbanded.
However, the City Council has continued to maintain an active Project Labor Agreement & Local Hiring Ordinance for PW Projects policy in the Adopted Council Priority Workplan. With future City projects on the horizon, it would be appropriate to establish a new Temporary Ad-Hoc Subcommittee to work with the City Manager, City Attorney, Special Legal Counsel, and staff to formulate a policy for future Council consideration.
The City Manager and City Attorney have recently executed a contract for legal professional services with Julian Gross who was retained in 2013 for similar scope of services for the City.
Temporary Ad-Hoc SubCommittee
In accordance with SPMC 2.16.070, the Mayor maintains the authority to make recommendations of all City Councilmembers to designated City Council Committee Assignments, Temporary Ad-Hoc Subcommittees, and Standing Subcommittees appointments subject to majority vote of the City Council.
On January 19, 2016, the City Council adopted Resolution 2016-004 which affirmed recommendations made by Mayor Kinney to all City Council assignments and Standing Committees. At this time, the City Manager requests that the Mayor recommend appointment of two (2) councilmembers to a newly established Temporary Ad Hoc Subcommittee on Project Labor and Local Hire Contracting Provisions through FY 2016/17.
FISCAL IMPACT
This action, if approved, will result in minor fiscal impacts-primarily time and materials spent by City employees to staff and support the subcommittee. These costs will be borne within existing approved budgets.
