BACKGROUND
The City Council maintains a listing of active City Council appointments for each Calendar Year that are individual Councilmember assignments to Council Committees, local and regional bodies, organizations, and committees, Joint Powers Authority Board of Directors (in which case the City is an official member), and other quasi-public agencies involving a number of public policy areas., including representation on the San Pablo Economic Development Corporation (SPEDC) in accordance with SPEDC adopted by-laws.
All Councilmember assignments are subject to appointment by the Mayor per San Pablo Municipal Code section 2.16.070, affirmed by majority vote of the City Council. Additionally, the Council nominates representatives to the San Pablo Economic Development Corporation (SPEDC) Board by majority vote of the City Council.
Proposed Changes to 2019 Council Assignments
Following formal City Council action taken in January and March 2019 to affirm City Council Assignments for Calendar Year 2019 per adopted Resolutions #2019-011, #2019-012, #2019-014, #2019-015, #2019-016, and #2019-027, the following Council discussion issues have emerged that necessitate consideration by the City Council:
• Discussion Issue #1: Vice Mayor Cruz Committee Resignations
On April 8, 2019, the City Manager received an email notification from Vice Mayor Cruz who provided his resignation from his primary Councilmember assignments to the Marin Clean Energy Board of Directors and Sister City Manzanillo Committee (See Attachment). Therefore, the following Council assignments are vacant requiring City Council deliberation this evening as follows:
v Marin Clean Energy: Primary Representative (vacant)
v Sister City Manzanillo Committee: Primary Representative (vacant)
• Discussion Issue #2: CCTA CBTP Council Assignment
On February 28, 2019, the Contra Costa Transportation Authority (CCTA) requested a Council representative to the newly established Richmond Steering Committee for the development of the Community-Based Transportation Plan (CBTP) (See Attachment). Unfortunately, due to time constraints with official notification and receipt of this letter, Mayor Kinney recommended Councilmember Pabon-Alvarado serve as the Council representative to the CBTP Committee via email on 04/14/19 until this recommendation could be ratified by majority vote of the City Council at its next regular meeting pursuant to SPMC Section 2.16.070. Therefore, the City Council must formally affirm this Councilmember assignment by majority vote this evening, as follows:
v CCTA CBTP Council Representative: Councilmember Pabon-Alvarado (as recommended by Mayor Kinney on 04/14/19 via email per SPMC 2.16.070)
City Manager Recommendation
Due to ongoing operational concerns for Councilmember assignments for the remainder of the CY 2019 period, the City Manager suggests the following recommendations be taken into consideration by the City Council during deliberation on changes to the CY 2019 Council Assignments, as follows:
Marin Clean Energy (MCE) Board of Directors:
1. Affirm Councilmember Pabon-Alvarado as the primary City Council representative with no alternate Councilmember appointment at this time until further notice; and
2. Authorize the Mayor and City Manager to make formal contact with West County Mayors’ and Supervisors’ Association and MCE staff to discuss possible formal consolidation of MCE Board representatives for individual member cities in West Contra Costa County (i.e. Cities of Richmond, El Cerrito, Pinole and San Pablo) into one (1) potential regional MCE Board appointee pursuant to Amendment No. 11 (Section 4.2, 4.21 - Appointment and Removal of Board of Directors) (See Attachment).
Sister City Manzanillo Committee:
1. Maintain one (1) Councilmember representative (i.e. Councilmember Pabon-Alvarado) with no alternate Councilmember appointment at this time until further notice; and
2. Direct the City Manager to return to the City Council with a future policy discussion on the function, governance and role of the Sister City Manzanillo Committee due to its formal establishment as a non-profit, 501 (c 3) organization in December 1970, with a discussion about the City Council’s role on a separate nonprofit’s Board of Directors.
