FY 2015-16 Council Priority Workplan Compliance Statement
Infrastructure - Capital Improvement Projects - PW 531 BNSF Site Clean Up and Development of Soccer Fields was an adopted policy item contained in the FY 2015-17 Adopted City Council Priority Workplan, effective October 1, 2016.
CEQA Compliance Statement
This update is not a project and is for informational purpose only, therefore does not require CEQA clearance. However, the original project (PW 531) was determined to not have a significant effect on the environment and had a Notice of Determination issued for a Negative Declaration pursuant to the provisions of CEQA. The Notice of Determination was filed with the County Clerk on March 20, 2013.
BACKGROUND
In 2003 the City of San Pablo acquired 1509 Rumrill Boulevard (the former BNSF Railroad site) to redevelop the parcel into a soccer field complex. The site is approximately 4.3 acres, and was subject to soil contamination due to waste disposal and storage of hazardous materials. The City was awarded the following grants to redevelop the site: $3 million in State Proposition 84 grant funding for the sports park development; $600,000 from the Environmental Protection Agency (EPA) for Brownfields clean-up; $425,000 in Measure WW funding from East Bay Regional Parks District for the project; and $125,000 from a CalRecycle grant for the turf. The City is also worked with the San Pablo Economic Development Corporation to fund the project through New Markets Tax Credits. In August of 2014 construction commenced and the Rumrill Sports Complex was opened in October of 2016.
Due to the soil contamination at the site, the City worked with the Department of Toxic Substances Control (DTSC) to develop the following documents:
• Remedial Action Workplan (RAW) - The RAW summarized the findings from new and previous characterization activities, provided estimates of the affected area, proposed measures to reduce or remove contaminates and set remedial action objectives.
• Removal Action Completion Report (RACER) - The RACER documented the completion of the remedial actives conducted at the site. The RACER was completed in October of 2016 and determined the project’s remedial action objectives were achieved and the site is acceptable for use by the public as an athletic complex.
• Operations & Maintenance Plan (O&M Plan) - The O&M Plan presents the policies and procedures for long-term operation, maintenance, monitoring and inspection related to the surface cap constructed at Rumrill Sports Complex.
• Operation & Maintenance Agreement - The City has entered into an agreement with DTSC to operate and maintain Rumrill Sports Complex in accordance with the O&M Plan.
• Land Use Covenant (LUC) - The City has entered into an agreement with DTSC to prohibit specific uses and activities at Rumrill Sports Complex. The City is in compliance with the LUC.
With the completion of these documents the City is now in the long term operations and maintenance phase of the project. In accordance with the O&M Plan and Agreement, the City will be conducting annual inspections and submitting the required reports to DTSC.
FISCAL IMPACT
As part of the ongoing maintenance and operation of the site the City will be required to perform annual inspections. It is estimated that it will cost approximately $9,000 for a qualified consultant to perform the inspection and approximately $15,000 for DTSC to review and approve the reports for a total estimated cost of $24,000. These expenses will be included in future years operating budgets.
