CEQA Compliance Statement
The project is categorically exempt under the California Environmental Quality Act, Section 15301(c) of the CEQA Regulations, Existing Facilities. A Notice of Exemption was filed with the Contra Costa County Clerk on November 13, 2017.
BACKGROUND
At the intersection of El Portal Drive and Fordham Street, near the site of a major EMBUD water line rupture in 2011, an 18-inch storm drain carrying storm water runoff from the unincorporated Rollingwood subdivision has settled. It is believed that this has contributed to soil being washed away from under the surrounding roadway, sidewalk and retaining wall that holds up the road, thus undermining the infrastructure. The roadway deterioration required the City to conduct multiple efforts to patch the roadway. However, the runoff scouring the hillside down to San Pablo Creek and further destabilizing of the retaining wall remained. As discussed in previous staff reports (including November 20, 2017 and December 4, 2017 reports), the project to repair the roadway has been separated into two (2) phases. The first phase, and the subject of this staff report, repaved the failed section of roadway including the attached curb, gutter and sidewalk, and repaired the storm drain line and grouted under the retaining wall. The second phase will investigate a permanent solution to the ongoing erosion of the embankment.
Discussions have been held with EBMUD and the County/Flood Control District regarding the causes of these problems and responsibility of these entities for those problems. The parties entered into tolling agreements which allowed work to proceed while putting a hold on any legal proceedings.
On November 20, 2017, pursuant to Resolution 2017-218, the City Council awarded the construction contract to Kerex Engineering and approved the contract at $81,868 plus a 15% contingency for a total funding allocation of $94,148, Inc. for the El Portal Road Settlement Project. On December 4, 2017, pursuant to Resolution 2017-496, the City Council authorized Change Order #1 in the amount of $63,940 to allow pavement reconstruction work to be added to the contract after EBMUD declined to undertake that work, bringing a total not to exceed contract authorization of $158,088.
The project was completed on February 13, 2018 in accordance with the plans and specifications. By adopting the attached Resolution, the City Council will accept the work as complete and authorize the City Engineer to issue a Notice of Completion. This action will allow title to the work to transfer from the Contractor to the City. A warranty bond has been submitted to the City, which obligates the contract to warranty the project for one year from acceptance.
FISCAL IMPACT
The final construction cost of $131,597, which includes an actual cost of $55,780 for Change Order #1, was less than the $158,088 appropriated for the project. The remaining balance of approximately $27,000 in project funding will flow back to the General Fund.
