BACKGROUND
Funding Source
The Supplemental Law Enforcement Services Grant is a mandated grant as defined by Government Code 30061(b)(3)(i) wherein the County shall remit at minimum $100,000 annually to be spent on frontline law enforcement. Grant revenues have accumulated and are available for appropriation.
Background
The City of San Pablo has committed to enhancing technology within the Police Department that enables staff to provide a higher quality level of service and increased public safety. Recent changes in law and the evolving climate of police work demands has increased the burden on staff to efficiently access multiple data sets and analyze that data in a short period of time. This is true of not only sworn personnel during criminal investigations, but also with professional staff fulfilling Public Records Act (PRA) and subpoena requests and general records management. The San Pablo Police Department has recognized the essential need for the delivery of information in today’s police department. This has become increasingly challenging as rapid changes in technology, and staff relying on technology services, has impacted work flow and efficiency which creates a necessity for a data integration platform.
There are nearly one million records of data residing in the Police Department’s current records management system (RMS). This RMS system does not integrate other data sources such as body-worn camera, ShotSpotter, and ALPR data. Furthermore, there is currently no functioning geographical information system (GIS) for staff to utilize, making internal searches and analysis of RMS data time-consuming and cumbersome. Staff currently must search multiple fields in multiple data bases for accurate analysis of crime trends, identifying priorities, and PRA and subpoena responses.
Peregrine Technologies
In November 2017, the San Pablo Police Department was approached by Peregrine Technologies to initiate a pilot program for data integration. Peregrine staff offered to volunteer within the Police Department to identify work flow issues related to data analysis and review. Due to the sensitive nature of data, the Peregrine Technologies staff were vetted through a background process similar to a police officer position, including a Department of Justice review. Peregrine began volunteering in February 2018 to create software solutions to integrate multiple sources of data into one platform. In September 2018, the Peregrine platform was deployed to selective units and staff members as part of a pilot program.
The Peregrine mobile field investigation (Mobile FI) application was developed to assist staff in the PATH Program. The PATH program consisted of dedicated sworn officers developing relationships with individuals suffering from homelessness to facilitate resources and assistance. The Mobile FI application allowed officers to use mobile devices to photograph and track homeless encampments accurately using GPS coordinates. Officers were also able to document contacts with individuals which greatly assisted in collecting data to identify resource allocation needs.
Peregrine staff assisted a homicide investigation from 2017. Peregrine developed invaluable mapping tools to analyze cell phone data which visually outlined the suspect’s movement before and after the shooting. Peregrine CEO Nick Noone provided testimony which aided in the successful prosecution of two gang members responsible for the murder.
Effective July 1, 2019, AB 748 is new legislation that requires agencies, to produce video and audio recordings of “critical incidents,” in response to PRA requests. Staff believes Peregrine software will greatly assist in preparation of new requests. Staff have already utilized Peregrine software to assist in Public Records Act requests by integrating multiple data sources, decreasing staff time, and providing responses efficiently.
By 2023, SPPD will be mandated to report 16 points of data for every police stop, pursuant to the Racial and Identity Profiling Act (“RIPA,” AB 953). The Mobile FI application will be fully deployed within two months and will allow SPPD to be fully integrated, trained and prepared to meet RIPA requirements quickly. This application will replace the antiquated process of handwriting information, submitting it for review and approval, and have staff manually enter each data point for every contact.
Peregrine Technologies is prepared to place the software and Mobile FI application into production. Staff will continue to offer feedback to enhance the platforms. All training, future applicable data integrations, product development, and support, which includes 24/7 technical support, will be included in the purchase of a software license with Peregrine Technologies.
Waiver of Formal Bid Requirements
Peregrine is an advanced analytic platform that provides a single point of access to view and analyze large-scale data from various data sources. The software performs several critical functionalities, including: data integration, search and information retrieval, advanced analytics, data management, collaboration, access control, and security. The software was developed to enhance investigatory capabilities, streamline criminal analysis, and generate intelligence products for Law Enforcement. Peregrine creates a unique and extremely efficient method for turning large amounts of raw data into useful analysis products, quickly and with significant reduction in staffing time.
Peregrine was designed for complete system interoperability and supports existing record management systems, case management systems, evidence management systems, arrest records, warrant data, subpoenaed data, computer aided dispatch (CAD) data, gang intelligence data, suspicious activity reports, automated license plate reader (ALPR) data, and unstructured data such as document repositories, imagery, and video.
Peregrine uniquely allows network-wide collaboration that is supported by Peregrine’s security model; which allows analysts, investigators, and command staff to share data and analyze products and briefs that are finished or in progress, including the underlying data. Because of this security model, agencies that use Peregrine can seamlessly and securely share/exchange information.
These systems have been developed specifically for the San Pablo Police Department’s needs. This includes specific technology and data source integrations unique to the Police Department’s records management systems with work flow input directly from staff. All other possible vendors offering similar solutions would require additional costs for product development and review. This phase of learning integration has been satisfied during the period of volunteer work by Peregrine.
Staff recommends the procurement of the Peregrine Technologies software be exempted from City bidding requirements because: 1) it involves specialized services combined with equipment and products, in which the City acquires and installs equipment but must also retain specialized services for consulting on use, training, installing, maintaining, and servicing the products (San Pablo Municipal Code section 3.16.110(B); and 2) the unique software attributes discussed above support the use of sole source agreements (San Pablo Municipal Code section 3.16.110(C).
Further, competitive bidding requirements may be dispensed if the public interest is better served by doing so, as where competitive bidding would not produce an advantage. (Graydon v. Pasadena Redevelopment Agency (1980) 104 Cal.App.3d 631; Los Angeles Dredging Co. v. Long Beach (1930) 210 Cal.348.) The exception may be invoked where the product or service contracted for is of unique value and may not be obtained elsewhere (Hodgeman v. City of San Diego (1942) 53 Cal.App.2d 610,618).
Acquisition pursuant to the specialized services and equipment exception and sole source justification are met because the goods and services required to satisfy the agency’s specific technology needs and product integration are only developed and available for purchase from Peregrine Technologies. Peregrine Technologies is the sole developer and vendor of the proprietary Peregrine software and Mobile FI application. The San Pablo Police Department has not been able to find another vendor to reliably deliver a combination integration and service platform. The Agreement with Peregrine follows a software licensing agreement model and does not contain the broader indemnification provisions in the City’s template professional services agreement. This is consistent with industry standards for software licenses and with other software license agreements that the City has executed.
Appropriate Funding
The cost of the Peregrine Technologies software license for one year shall not exceed $100,000. The Police Department proposes to appropriate $100,000 in Supplemental Law Enforcement Grant funds for the purchase of a software license agreement with Peregrine Technologies, which will enable the Department to maximize available technology and provide greater operational efficiency. With the proven technology the Police Department already has in place, including ShotSpotter, automated license plate readers, body-worn cameras, surveillance cameras, and Government Outreach, Peregrine will allow staff the opportunity to access multiple sources of data efficiently and enhance overall productivity.
Public Safety Standing Committee
The Chief of Police presented Peregrine Technologies and this requested procurement to the Public Safety Standing Committee (former Mayor Calloway and former Council Member Morris) on December 4, 2018. The Committee voted to receive the presentation and recommended it be forwarded to City Council for formal consideration.
FISCAL IMPACT
The appropriation of $100,000 will cover the quoted cost of the software license for Peregrine Technologies for one year and there are sufficient grant revenues accumulated and available for appropriation from fund balance in grant fund (210) to cover the cost.
