PREPARED BY: ELIZABETH LOPEZ DATE OF MEETING: 07/07/2025
SUBJECT:
TITLE
CONSIDER ADOPTING RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A THIRD AMENDMENT TO AGREEMENT WITH MACK5 FOR PROJECT AND CONSTRUCTION MANAGEMENT SERVICES FOR THE NEW SAN PABLO POLICE HEADQUARTERS AND TRAINING FACILITY INCREASING COMPENSATION BY $94,813 TO COVER SPECIAL TESTING AND INSPECTIONS, AND PROJECT SCHEDULE FOR A NEW TOTAL CONTRACT AMOUNT OF $1,197,206
CEQA: The City with the assistance of Michael Baker and Associates (MBA) concluded that the proposed Police Department Headquarters and Public Safety Training Project (“project”) is consistent with the existing land use and zoning designations for the site and will not result in an increase in the severity of impacts identified in the prior Environmental Impact Reports (EIR’s) or Mitigated Negative Declaration (MND) or in any new impacts not previously considered in the prior EIRs and MND. In accordance with this analysis, MDA prepared addenda to the two EIRs and the MND, which the City Council considered and approved on December 20, 2021.

Improve Public Safety is a Major Policy Goal under the FY 2025-27 Council Priority Workplan, effective April 7, 2025.
BACKGROUND
On December 20, 2021, the City of San Pablo approved the issuance of lease revenue bonds and authorized the appropriation of funding for a future Police Headquarters and Public Safety Training Center (the “New Police Facility”) to be located at 1050 Gateway Avenue, directly north of the new City Hall. The New Police Facility will consist of a two-story building of approximately 42,000 square feet. It will accommodate approximately 88 full time Police Department employees, instructional and training uses, a future mental health crisis deployment office, drone technology deployment, a K-9 training area, and additional classroom settings, mat rooms, and multi-lane pistol and rifle ranges (indoors). It is intended that the facility will be designed to achieve a LEED certified level (or equivalent) and will have an architectural style consistent with that of the San Pablo City Hall.
On September 30, 2021, the City released a Request for Proposals and Qualifications for Construction Management/Project Management Services for the New Police Facility. The City received six proposals. After review and interviews, City staff determined that Mack5 best demonstrated the experience, expertise and qualifications necessary to perform the services and requirements outlined in the RFPQ.
On January 19, 2022, pursuant to Resolution 2022-009, the City entered into an Agreement with Mack5 for project and construction management services for the New Police Facility. The agreement was in the amount of $882,925.
On November 21, 2023, the First Amendment to Agreement (the “First Amendment”) was executed which increased the compensation by $169,468 and amended the scope of services to include the additional services.
On July 18, 2024, the Second Amendment to Agreement (the "Second Amendment") was executed which increased the compensation by $50,000.
Additional services, including special testing and inspections, and project schedule extension, are needed for the New Police Facility, and it is therefore necessary to increase the compensation payable to Mack5.
The proposed resolution approves and authorizes the City Manager to execute the Third Amendment to Agreement (the “Third Amendment”) which increases the compensation by $94,813.
FISCAL IMPACT
The $94,813 funding for the Third Amendment will be expended from account 320-0104-43605-GFD-422. Sufficient funding exists in the project appropriation, no new appropriation is required.
