FY 2025-2027 Council Priority Workplan Compliance Statements:

Item 513 - Continue Efforts to Support Hillside Protection and Sustain City Drainage Infrastructure is a major policy goal contained in the FY 2025-27 City Council Priority Workplan, adopted on April 7, 2025.

 

BACKGROUND

On April 21, 2025, the City Council ratified, by unanimous vote, emergency actions previously taken by the City Manager (Resolution 2025-049) pursuant to Public Contract Code Section 22050 and San Pablo Municipal Code Section 3.16.110.a.  This action included entering into a contract with Golden Bay Construction for $52,360 and authorization for emergency procurement actions.

 

A Notice to Proceed was issued for April 15, 2025, allowing Golden Bay Construction Inc. to begin emergency work, with an expected completion within 28 calendar days. 

 

Golden Bay Construction began excavation and replacement of the existing storm drain on April 28, 2025 and completed the backfill and restoration of the hillside on April 29, 2025.

 

The original bid included the restoration of concrete steps; however, Golden Bay Construction managed to repair the pipe while leaving the existing concrete steps intact.  Therefore, a contract change order was issued on May 7, 2025, which removed the restoration scope from the contract.

 

The final contract amount to Golden Bay Construction, Inc. is $33,950.  The proposed final estimate letter was issued on May 2, 2025 and was accepted by Golden Bay Construction.  The final project costs are indicated in the table below.

 

The homeowner has been formally notified of the project's completion and has acknowledged satisfaction with the property's condition as left by the contractor. 

 

The City Engineer has determined that the above work has been completed in accordance with the plans and specifications.

 

Staff is requesting that the City Council review this report and terminate, by four-fifths vote, the emergency procurement actions undertaken by the City Manager pursuant to Public Contract Code Section 22050 for the storm drain repair work at 1850 Mesa Buena Avenue.

 

By adopting the attached resolution, the Council will accept the work as complete and authorize the City Engineer to issue a Notice of Completion.  This action will allow the title of the work to transfer from the Contractor to the City and will enable processing the final payment.

 

The City is holding 5% retention on this project. After the prescribed period of recordation of the Notice of Completion, the City will release the final retention.

The remaining estimated funds in the amount of $44,315 will remain in the Leroy Heights Storm Drain Project (0306).  The full repair of the storm drain system between Mesa Buena Avenue and Miner Avenue will be addressed.
