Expand safe, family friendly park space is an adopted priority item under the FY 2023-25 City Council Priority Workplan, effective May 1, 2023.
BACKGROUND
On October 27, 2023, Andre Williams, President of the San Pablo Baseball Association (SPBA), submitted a letter to the City of San Pablo requesting a waiver of rental fees for use of Davis Park Sports Fields and Davis Park Concession Stand for the following dates:
February 1, 2024 - June 15, 2024
• Monday - Friday 4:00 pm-8:45 pm
• Saturday - Sunday 8:00 am - 4:00 pm
• Exceptions: City Holidays/Closure Dates
SPBA offers a diverse baseball program that provides approximately 80 San Pablo youth the ability to travel to numerous cities and compete against various baseball teams. Participants are recognized for their accomplishments in athletics as well as scholastics to assure them that they are always winners for taking the initiative to do their best.
The SPBA has partnered with Peacemakers, Inc. and is currently operating under Peacemaker’s 501(c)(3) status. City of San Pablo staff has received written verification of this partnership and Peacemakers, Inc.’s 501(c)(3) status is in good standing.
As part of the SPBA’s 2023-24 contract, the City continues to stress the importance of item 17 of the Sports Field Rental Agreement regarding Davis Park parking regulations which requires that all parking and drop-off for Davis Park Fields is to be done in the parking lot provided for the facility. There is to be no parking or dropping off in neighborhood streets or cul-de-sacs. All user groups are responsible for communicating this to participants in writing and continually monitoring for compliance. Failure of a user group and participants to comply will result in the program/rental being cancelled. This is in response to previous years’ complaints from neighbors resulting in community meetings with the San Pablo Police Department, SPBA, Community Services Department staff, and the public.
At the time of submittal, SPBA was still accepting enrollment for its 2024 Winter/Spring Season and therefore does not yet have complete participant rosters. Once registration is closed and final rosters have been received, staff will review and report the residency findings to the City Manager.
Organizations requesting fee waivers need to submit supporting paperwork such as articles of incorporation, updated roster/membership, list of organization officers and contact information, certificate of insurance, and copy of the organization’s by-laws.
As a condition of the fee waivers for use of the Davis Park Sports Fields, a representative of the SPBA must participate in at least two of the following three major City events: Fourth of July, Holiday Tree Lighting, and City Hall-O-Ween. In addition, participants of SPBA programs who reside within the incorporated City of San Pablo boundaries receive a reduced registration rate.
Staff recommends City Council approve a fee waiver for SPBA’s use of the Davis Park Concession Stand and Sports Fields for the requested dates and times through June 15, 2024, subject to the conditions outlined above.
COMMUNITY SERVICES STANDING COMMITTEE
On December 5, 2023, this item was taken before the Community Services Standing Committee (Cruz/Pineda) for its review and the Committee unanimously recommended moving forward to City Council to approve the waiver of fees for the use of Davis Park Fields and Concession Stand as outlined in this staff report.
FISCAL IMPACT
The proposed resolution will result in a loss of approximately $24,610 in rental revenues to the City General Fund.
