Item 202: Develop and Implement Long-Term Environmental Stewardship Goals is an adopted policy item under the FY 2023-25 Council Priority Workplan, effective May 1, 2023.
BACKGROUND
Senate Bill (SB) 1383 sets a statewide goal for the reduction in organic waste to landfills - 50% by 2020 and 75% by 2025 - in addition to the recovery of 20% of edible food waste for human consumption. SB 1383 delegates the California Department of Resources Recycling and Recovery (“CalRecycle”) as the regulatory authority to achieve the organic waste disposal reduction targets.
On November 20, 2023, through Resolution 2023-162, City Council ratified the City’s SB 1383 Local Assistance Grant Program application to CalRecycle for implementation of SB 1383 activities.
On February 20, 2024, through Resolution 2024-030, City Council authorized the modification of the grant application, however the Resolution was missing the required language authorizing the City Manager to execute all documents necessary for City participation in this grant program. As such, staff is recommending an amendment to Resolution 2024-030 to make the necessary corrections in the Resolution language.
The grant award is pending a corrected Resolution, see the attached Notice of Grant Award.
SB 1383 Local Assistance Grant Program
The funding amount for each jurisdiction is based on per capita calculations. The City of San Pablo is eligible for at least $75,000 in grant funding during fiscal year 2023/2024. The City submitted a grant application to CalRecycle in November 2023 to receive a total of $75,000 in grant funding. However, CalRecycle notified City staff in February 2024 that there is additional funding the City is eligible for that was not previously known at the time of the application. Because not all jurisdictions applied for this funding, those funds plus additional funds that became available will be redistributed to the jurisdictions that did apply which increases the amount that the City of San Pablo will be able to receive. CalRecycle has notified City staff that the City of San Pablo is now eligible for a maximum amount of $89,149 in grant funds, an addition of $14,189 from the previous allocation. To receive the maximum amount of funding the City is eligible for, City staff are required to submit an updated Resolution to CalRecycle. The grant will fund the following activities:
1. Procurement:
• SB1383-compliant mulch
• Janitorial paper products
• 30% post-consumer recycled content paper products.
2. Personnel: City staff time spent on activities related to the implementation of SB 1383 regulations including:
• Overseeing the procurement of mulch to ensure they are from approved facilities;
• Publishing educational materials on the City’s website, Facebook, and Nextdoor;
• Providing internal training on the City’s Environmentally Preferable Purchasing Policy and on documenting purchases of 30% recycled content products; and
• Recordkeeping of documents required for the City’s Implementation Record.
Staff recommends authorizing the CalRecycle grant application for the City to receive the maximum amount of $89,149 and accept and appropriate the new grant amount.
FISCAL IMPACT
If the funding request is accepted by CalRecycle, the City will receive a maximum amount of $89,149 in fiscal year 2023/24. As such, the previous allocation amount will be modified to the maximum amount and will be appropriated as follows:

There is no requirement for the CalRecycle SB 1383 Local Assistance Grant Program that the City contribute any additional matching funds to use the grant. However, City staff hours will be dedicated to implement SB 1383 implementation activities included in the grant. Although the majority of staff time to implement these activities will be covered by the grant, the remainder is included in the Public Works Department operational budget. These activities are required to meet the SB 1383 requirements for the City.
