Compliance statements

The Annual ADA Sidewalk Project (ADA-SWK) is an adopted policy item under the Infrastructure policy area, Street Maintenance section I, Public Works category of the FY 2015-17 City Council Priority Workplan, effective October 1, 2016.

 

CEQA Compliance Statement

The project is categorically exempt under the California Environmental Quality Act, Section 15302 of the CEQA Regulations, Replacement or Reconstruction.

 

BACKGROUND

The Annual ADA Sidewalk Project consists of but is not limited to the removal and installation of aggregate base, rebar, concrete panels, and asphalt.

 

On May 18, 2017, the project was advertised for bids and the submittals were opened on June 5, 2017. Staff reviewed the bids and determined Malachi Paving and Grading, Inc. did not include the required signed non-collusion declaration, but has since submitted it.  The City retained the discretion under section 12, “Instructions to Bidders” in the bidding documents to waive minor irregularities. Staff does not believe waiving this irregularity created an unfair process as Malachi would not have been allowed to withdraw its bid without forfeiting the bid bond in this situation.  Thus, the irregularity did not affect other components of bid responsiveness:  the amount of the bid, favoritism, or the ability to make bid comparisons.  There also appeared to be some issues regarding the downloading of plans from BPXpress, but staff likewise finds this to be a minor irregularity as the bidders did have the plans and submitted bids.

 

Staff therefore, recommends the City Council waive the irregularities and award the project to Malachi Paving and Grading, Inc as the lowest responsive and responsible bidder in the amount of $93,875 (“Contract Amount”) for construction.

The Improvements include the demolition and construction of concrete sidewalk, curb and gutter to comply with ADA standards around the new San Pablo Library (13751 San Pablo Avenue) located on the corner of Church Lane and San Pablo Avenue.

 

In accordance with California Public Contract Code Section 220382(b), the City Council must award the work to the lowest responsive and responsible bidder. In accordance with California Public Contract Code Section 22039, Staff recommends that the City Council adopt the plans, specifications and working details for the Improvements which were approved for bidding by the City’s Engineering and Environmental Services Division.

 

FISCAL IMPACT

The Malachi Paving & Grading, Inc. contract amount is $93,875 with an approximate 7 percent contingency amount of $6,125, for a total authorization amount of $100,000. Total funding in the amount of $100,000 needs to be appropriated from the FY 16/17 General Fund Designated Reserve / Future Capital Projects for ADA Compliance & Improvement Projects City-Wide (320-3200-43600-ADA-SWK).
