APPROVING APPLICATIONS FOR GRANT FUNDS FROM THE CALIFORNIA STATE DEPARTMENT OF PARKS AND RECREATION BUDGET ACT OF 2023, AND AUTHORIZING THE CITY MANAGER TO EXECUTE AND SUBMIT THE GRANT APPLICATION AND ANY OTHER NECESSARY DOCUMENTS RELATED TO THIS GRANT.

CEQA: The San Pablo Area for Recreation and Community (SPARC) Project is categorically exempt pursuant to Section 15304 of the State CEQA Guidelines. Section 15304 exempts from environmental review “minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes.” The Project would involve alteration of the site from an empty lot with demolition debris to a park, including grading, new landscaping, and minor trenching and backfilling where the surface is restored. The Project would not remove any mature trees; the trees within and adjacent to the Project site would be preserved in place.

The Project also meets the criteria for the In-Fill Development Project categorical exemption, pursuant to Section 15332 of the State CEQA Guidelines, which exempts from environmental review in-fill development projects that meet five specific criteria. The Project complies with these five criteria.

The Public Works Department filed a Notice of Exemption (NOE), dated November 11, 2023, with the Contra Costa County Clerk and the State of California Office of Planning and Research.

Build a Healthy Community - 105. Expand Safe, Family-Friendly Park Space and Enhance Community Resilience - 202. Develop Long-Term Environmental Stewardship Goals are Major Policy Goals under the FY 2023-25 City Council Priority Workplan, effective May 1, 2023.

BACKGROUND

On March 21, 2022, through Resolution 2022- 041, the City Council approved the City of San Pablo’s grant application to the California Natural Resources Agency (CNRA) for an Urban Greening Grant to partially fund the San Pablo Area for Recreation and Community (SPARC) Park Project (Project).  The City Council also authorized the City Manager to execute a grant agreement and any other necessary agreements associated with this grant.

Consistent with City Council approval, the City Manager and CNRA Deputy Assistant Secretary signed a $4,790,690 Urban Greening Grant agreement in late August 2023.  This agreement includes $600,000 for project design, $35,000 for public outreach and education, and about $4.15M for project construction and funds for other miscellaneous project expenses.

The Project located at 2600 Moraga Avenue will create a new 4.8-acre park, which envisions a soccer field, playground with all-abilities equipment, basketball court, small stage amphitheater, exercise stations, a fitness trail, bathrooms, and picnic table area.

Design

On November 21, 2023, staff issued a Request for Proposals (RFP) for Design and Engineering Services for the Project (PW No. 0501).  The RFP also included provisions for two (2) bilingual community workshops.   Staff received seven (7) proposals and after review and evaluation in accordance with the terms of the RFP, staff determined that the consultant firm of CSW/ Stuber-Stroeh Engineering Group, Inc. (CSW|ST2) of Richmond, California, presented the best overall project proposal.  Staff recommends CSW|ST2 for selection for the requested design and engineering services.

The term of the agreement will be until the completion of the project, which is expected to be February of 2026.  The consultant services agreement will be in the amount of $545,140.  A 10% contingency to the base agreement in the amount of $54,514 will accumulate to a total authorization amount of $599,654.

Staff also seeks approval to appropriate $635,000 of CNRA Urban Greening Grant.  This appropriation would include up to $600,000 for engineering design and up to $35,000 for public outreach and education expenses.

State Park Grant

Additional funding for the SPARC project is being awarded by the State of California Department of Parks and Recreation via the Office of Grants and Local Services (OGALS).  This specified grant originated through Assembly Member Buffy Wicks, District 14, from a line item in the State of California Budget for fiscal year 2023-24.  A City Council resolution is required before a funding agreement will be issued, and an approved application packet is required before grant payments can be approved.  The grant performance period is July 1, 2023 through June 30, 2027.  This funding grant is in the amount of $3,000,000, which will be used during the construction phase.

Staff is also requesting that City Council adopt a second resolution to authorize the City Manager to execute the grant application and any necessary agreements related to this grant.
