BACKGROUND
The City of San Pablo is a member agency of the West Contra Costa Integrated Waste Management Authority (WCCIWMA) / Recyclemore Joint Powers Authority (Authority) and maintains Board of Director representation on the Authority’s Board which meets officially monthly under matters pertaining to the adopted Joint Exercise of Powers Agreement in effect since 1991, last amended in 2019.
On January 20, 2026, pursuant to Resolution 2026-007, the City Council confirmed the following representation to the Authority Board during its discussions on City Council Annual Assignments for the calendar year 2026, as follows:
• Vice-Mayor Rita Xavier (Primary)
• Councilmember Abel Pineda (Alternate)
WCCIWMA Board Officers - February 2026
On February 12, 2026, during its annual election of Board Officers, Vice-Mayor Rita Xavier was selected as the new Authority Board Chair which was affirmed by Authority Board action in accordance with Section 7.4 of the Joint Exercise of Powers Agreement.
Following its election of Board Officers, Authority staff desired to hold monthly scheduled Authority Board meetings at the City Council Chambers of the sitting Chair which is consistent with past practice. As a result, the Authority Executive Director contacted the City Manager’s Office to establish a Memorandum of Understanding (MOU) for using the City Council Chambers for monthly scheduled Authority Board meetings during calendar year 2026.
Proposed MOU between Authority and City of San Pablo
The City Manager and City Attorney have jointly developed a proposed MOU to enable Authority’s use of the Council Chambers, with appropriate fees for City support services to support Authority monthly scheduled meetings to occur on the 2nd Thursday each month, after the City’s regular business hours beginning at 6:00p.m., with Authority staff access beginning at 5:00p.m. Following MOU development, the MOU was prepared and reviewed mutually by both parties and approved by the Authority's Board on February 12, 2026.
Subsequently, the City Council must authorize the City Manager to execute the MOU, including charges for all City support services, with a 3-hour minimum per Authority Board meeting (See Attachment). The MOU, once adopted by the City Council, would commence the Authority’s use of the Council Chambers beginning March 12, 2026. It is anticipated that the Authority’s use of the Council Chambers will be for the remainder of calendar year 2026, and the MOU may be terminated upon 30-days prior written notice.
The Authority shall pay the City for all Authority Board of Director meetings that are conducted after the City’s regular business hours, with a 3-hour minimum rate, as follows:
• $24/hour for the services of a Building Attendant staff, with a three-hour minimum rate of $72 for each Board meeting;
• $88/hour for IT support services staff with a three-hour minimum rate of $264 for each Board meeting; and
• For Authority meetings that go beyond three (3) hours, the Authority shall be charged at the hourly rates set forth above, for any portion of an hour without proration, for both Building Attendant and IT support service staff.
The Memorandum of Understanding also stipulates the Authority’s responsibility for damages and repairs, outlines the necessary insurance provisions, and includes a comprehensive indemnification clause between the two respective agencies.
FISCAL IMPACT
The City of San Pablo incurs no budget impacts with this proposed MOU. The Authority will cover all costs for using the Council Chambers for its monthly scheduled Board meetings, with invoices issued for payment by the City.
