Build a Healthy Community: Priority 109 Develop Public Facilities for Active Living (Parks, Open Space, Sidewalks, Trails, Bike Lanes, Etc.) is an adopted policy item under the FY 2023-25 Council Priority Workplan, effective May 1, 2023.

BACKGROUND

The San Pablo Street Lighting and Landscape Assessment District No. 1982-1 was formed in August of 1982. The boundary of this District is identical to the incorporated limits of the City of San Pablo. This resolution preliminarily approves the Engineer’s Report, which describes the improvements, gives an estimate of the total cost of the improvements, contains a diagram of the District, and gives an estimate of the annual assessment for Fiscal Year 2024/25. This resolution also sets a date for a Public Hearing for June 17, 2024 and directs the publication of notice in accordance with the requirements of the Landscaping and Lighting Act of 1972 (Streets & Highways Code Section 22500).

The Engineer’s Report has been prepared by the City’s Consultant, LCC Engineering & Surveying, Inc. (LCC). The breakdown of costs included in the report is consistent with the Fiscal Year 2024/25 Street Lighting and Landscaping Assessment District budget. The Introduction to the Engineer’s Report is attached (See Attachment B). The full report, including the Assessment Roll, which lists the amount of the proposed assessment on each parcel of land within the District and the Assessment Diagram is on the website, located here:  <https://www.sanpabloca.gov/972/_-Street-Lighting> <https://www.sanpabloca.gov/972/_-Street-Lighting>

Following is a summary of the FY 2024/25 Street Lighting and Landscape Assessment District funded budget. Note that there is no increase proposed in the assessment rate.

The proposed expenditure of Street Lighting and Landscape Assessment District funds recommended for FY 2024/25 is  $1,853,326.00 as shown on “Table 2, Estimate of Cost” from the Engineer’s Report (See Attachment C). The cost includes HVAC replacement at the Senior Center, construction of the Bush Avenue Pocket Park, and roof replacement at the Community Center for FY2024/25. As shown above, the estimated FY2024/25 assessment revenues is $855,700.02.

It should be noted that this action merely preliminarily approves the Engineer’s Report and sets the date for a public hearing on the proposed assessment. The City Council may change the proposed assessment (reduction only) during its budget review process. In order for assessments to be collected within the existing District for the 2024/25 fiscal year, however, the Council must conduct a public hearing and order that the Assessment and Diagram be filed with the County Auditor not later than August 10, 2024.

FISCAL IMPACT

This action preliminary approves the Engineer’s Report and sets the date for a public hearing on the proposed assessment. No funds are expended or revenues generated, hence, there is no fiscal impact. The budgeted costs of services is $1,853,326.00 with the total revenues projected at $855,700.02. The assessment rate is not proposed to be increased over the FY24/25 assessment. The total approved FY 2024/25 budget for Street Lighting and Landscaping Assessment District-funded units exceeds the projected Assessment District revenues and will require additional supplemental funding from the General Fund, which has already been factored into the proposed FY 2024/25 General Fund Operating Budget, Resolution 24-182. The City Council may change the proposed assessment (reduction only) during its budget review process. According to the Engineer, a portion of the supplemental funding is required to offset any General Benefit, i.e. benefits that are not special to the assessed properties that may be received from the District improvements.
