CEQA Compliance Statement

The McNeil Park Project (formerly known as SPARC project) is categorically exempt from environmental review pursuant to Section 15304 of the State CEQA Guidelines. Section 15304 exempts from environmental review “minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes.” The Project would involve alteration of the site from an empty lot with demolition debris to a park, including grading, new landscaping, and minor trenching and backfilling where the surface is restored. The Project would not remove any mature trees; the trees within and adjacent to the Project site would be preserved in place.

 

The Public Works Department filed a Notice of Exemption (NOE), dated November 11, 2023, with the Contra Costa County Clerk and the State of California Office of Planning and Research.

Workplan Compliance statement

Build a Healthy Community: Expand Safe Family Friendly Park Space (McNeil Park) And Community Facilities-(105), Develop Public Facilities For Active Living (Parks, Open Space, Sidewalks, Trails, Bike Lanes, Etc.)-(109), are major policy goals contained in the FY 2025-27 City Council Priority Workplan, effective April 7, 2025.

 

BACKGROUND

The McNeil Park Project, located at 2600 Moraga Avenue, will create a new 4.8-acre community park. The project envisions the development of a soccer field, playground with all-abilities equipment, basketball court, small stage amphitheater, exercise stations, fitness trail, restrooms, and picnic table area. The park is intended to expand recreational opportunities, promote community wellness, and provide accessible open space amenities for residents.

 

On February 20, 2024, CSW/ Stuber-Stroeh Engineering Group, Inc., (CSW) was awarded a contract for engineering and design services for the McNeil Park Project (0501) (“Project”) in the amount of $545,140.  Resolution 2024-024, which authorized the contract, included a 10% contingency in the amount of $54,514, for a total authorization of $599,654.

 

Amendment No. 1 was executed on February 16, 2026, and was a no-cost time extension to the contract to extend the contract to July 31, 2026.

 

Amendment No. 2 is necessary to expand the scope to address the following items:

                     A study to evaluate potential artificial sports turf field products options for all artificial sports turf sites in the City including McNeil Park and Rumrill Sports Complex.

                     Evaluate the needs for the Rumrill Sports Park Turf Replacement Project (0503) within the context of the turf replacement study.

                     Development of the documents and regulatory requirements for the Rumrill Sports Park Turf Replacement Project (0503).

                     Assist the City with the procurement of any needed products through alternative procurement methods (i.e., CMAS) for both projects.

                     Assist the City with Section 106 NEPA compliance in accordance with the Land and Water Conservation Fund (LWCF) grant application guidelines for the McNeil Park Project (0501).

                     Contract term extension from February 28, 2026, to June 30, 2028, for ongoing design and construction assistance throughout the project construction phase.

 

Amendment No. 2 will be funded through both projects as outlined in the fiscal impact section.

 

Staff recommends authorizing the new scope of work and increasing CSW’s compensation by $219,013 for the proposed additional work, for a total compensation not to exceed $764,153 under the agreement as amended.  Staff further recommends increasing the contingency amount by $21,901 for a total contingency of $76,415 and a total authorized contract amount of $840,568.

 

In addition, the Project has experienced delays while awaiting the outcome of federal funding applications. The proposed amendment would extend CSW’s contract by two years, through June 2028, allowing CSW to provide bid and construction support during the construction phase.

 

FISCAL IMPACT

The proposed third amendment will increase the total compensation to $764,153. The total contingency authorization to the City Manager for this Agreement will be increased by $21,901, for a total contingency authorization not to exceed $76,415.  This will make the total authorized funding for the Agreement $840,568.

 

The amendment will be partially funded from the McNeil Park (0501) by the existing grants. In addition, for the scope of work associated with the Rumrill Turf Replacement Project (0503) will be funded through the existing project funds appropriated from Fund 130 - Building, Facilities & Park Maintenance Reserve

 

The fiscal impacts are outlined in the tables below.
