FY 2023-2025 Council Priority Workplan Compliance Statements:

Enhance Community Resilience - Priority 203: Assess Environmental Impacts over the Long-Term to Assist Resiliency Planning is a major policy goal contained in the FY 2025-27 City Council Priority Workplan, effective April 7, 2025.

 

BACKGROUND

The City of San Pablo (City) conducts various creek-related maintenance, restoration, and capital improvement projects that require the services of qualified biological consultants to ensure compliance with state and federal environmental regulations.

 

The City utilizes biological consulting services for the following ongoing activities:

 

Annual Creek Maintenance Inspections

Each year, the City performs maintenance activities within City-owned portions of Wildcat Creek and San Pablo Creek to remove trash, sediment, and vegetation that may impede water flow and increase flood risk. Pursuant to the City's Lake and Streambed Alteration Agreement (LSA) with the California Department of Fish and Wildlife (CDFW), a qualified biologist must oversee these activities and implement required environmental protection measures to minimize impacts to fish and wildlife resources.

 

Post-Construction Mitigation Monitoring

The Wildcat Creek Restoration and Greenway Trail Project was permitted by several regulatory agencies, including the U.S. Army Corps of Engineers, California Department of Fish and Wildlife, and San Francisco Bay Regional Water Quality Control Board. As a condition of permit approval, the City is required to conduct ten years of post-construction monitoring and reporting to evaluate the success of habitat restoration and mitigation measures implemented as part of the project. Annual biological assessments and regulatory reporting are required through the completion of the monitoring period.

 

 

On-Call Biological Services

The City periodically undertakes smaller capital improvement projects, emergency creek maintenance activities, and other projects requiring biological review, environmental permitting support, and regulatory agency coordination.

 

On July 19, 2021, the City Council authorized a Professional Services Agreement with Sequoia Ecological Consulting, Inc. (Sequoia) in an amount not to exceed $224,212. The agreement, awarded through a competitive Request for Proposals (RFP) process, provides ecological consulting services for the period spanning Fiscal Year 2021-22 through Fiscal Year 2025-26. Since that time, Sequoia has provided biological inspections, habitat monitoring, permit compliance support, and regulatory reporting for City creek maintenance and restoration projects. Amendment No. 1 subsequently extended the agreement term at no additional cost. The current agreement expires on June 30, 2026.

 

Staff recommends approval of Amendment No. 2 to increase the contract amount by $67,340 and extend the agreement term through June 30, 2027. The amendment will fund biological inspections, monitoring, permit compliance support, and regulatory reporting required for ongoing creek maintenance activities and completion of Year 5 post-construction monitoring for the Wildcat Creek Restoration and Greenway Trail Project.

 

Retaining Sequoia will provide continuity and efficiency as the firm has extensive knowledge of the project site, permit requirements, monitoring history, and regulatory reporting obligations.

 

FISCAL IMPACT

The proposed second amendment will increase compensation by up to $67,340, for a total compensation not to exceed $291,552 under the Agreement as amended. The total authorization to the City Manager for this Agreement will be increased for a total authorization not to exceed $291,552.

 

Funding for the amendment is available within the Engineering & Administration Division operating budget.
