Item 202: Develop and Implement Long-Term Environmental Stewardship Goals is an adopted policy item under the FY 2023-25 Council Priority Workplan, effective May 1, 2023.

 

BACKGROUND

As a result of the 1987 amendments to the Federal Clean Water Act, the Environmental Protection Agency (EPA) was given the authority to regulate stormwater discharges from municipal storm drains under the National Pollutant Discharge Elimination System (NPDES) regulations.  The objective of the NPDES program is to improve water quality and creek health through the reduction and/or elimination of polluted runoff.  The City of San Pablo’s NPDES Permit (No. CAS612008) was updated and reissued on July 1, 2022.  This new permit (MRP 3.0) has strict compliance requirements for trash reduction to creeks through the City’s storm drain network, known as provision C.10.

 

To comply with these new requirements, the City released a Request for Proposals (RFP) on March 23, 2023, to assist the City in updating the City’s C.10 Trash Load Reduction Compliance Plan to ensure full compliance with the C.10 requirements.  This includes:

                     submitting an updated Trash Reduction Plan with the 2023 Annual Report; and

                     developing a schedule of implementation to meet with 100% reduction or “no trash to the creeks” requirement by June 30, 2025.

 

The City received four (4) proposal responses from the RFP, which were evaluated by staff.  The consultant firm of Brown and Caldwell presented the best overall proposal and is recommended for selection for the requested services.

 

Staff requests that Council reallocate funds from two accounts to pay for the full cost of the agreement with Brown and Caldwell.  The Environmental Programs Division has had two vacant positions this fiscal year, one Environmental Program Analyst since February 2, 2023, and another Environmental Program Analyst since March 2, 2023.  Staff requests reallocation of $94,033 in salary savings in FY 2023/24 from those two vacant positions in the NDPES Fiscal Year 2022/23 NPDES Administration Salary Operating Budget (255-3510-41000) to the Trash Reduction Plan Project (0907).  This amount represents the unused budgeted salary for the two vacant positions from the time they were vacated until the end of the fiscal year in one case and through May 2023 in the other case (one position is expected to be filled as of June 1, 2023).  In addition, staff seeks reallocation of $8,121 previously allocated to NPDES Fiscal Year 2022/23 Professional Services Operating Budget (255-3510-43600) to fund the remaining portion of the Trash Reduction Plan Project (0907).

 

This item is to authorize the City Manager to enter into an agreement with Brown and Caldwell in an amount no to exceed $102,154.  The term of the agreement will be until the completion of the project, which is expected to be June 2024.
