Compliance statements

This action is not in the City Council’s Priority Workplan, but is necessary for the City to come into compliance with CalPERS compensation reporting requirements.

BACKGROUND

On February 4, 2019, the City Council adopted Resolution 2019-021, making various amendments to the City’s classification and compensation plan and approving executive management terms and conditions of employment for executive management employees, effective February 1, 2019. As a result of a comprehensive review of the City’s Classification and Compensation Plan, Resolution 2019-021, among other actions, added a 5% Management Incentive Pay (MIP) for the Chief of Police classification, effective February 1, 2019.

Upon the retirement of Police Chief Ron Raman in December 2023, staff was advised by the CalPERS Compensation Compliance Review team that the 5% Management Incentive Pay included in the Chief of Police total compensation did not meet the criteria for “special compensation” because it was not available to all positions in the Executive Management Group and would not be factored in Chief Raman’s retirement benefit calculation.

CalPERS further advised that in order to have the MIP be considered compensation for Chief Raman, and for Police Chiefs going forward, the City would have to amend Resolution 2019-021 by eliminating the 5% MIP; and amend the Executive Management Chief of Police Salary Schedule by increasing the base salary rate by 5% retro-active to February 1, 2019.

All other provisions of Resolution 2019-021 would remain in full force and effect, except as superseded by this Resolution or other resolutions of the City Council.

FISCAL IMPACT

The proposed resolution has no fiscal impact.
