Body

FY 2023-2025 council priority workplan statement

This action is not in the City Council’s Priority Workplan, but is necessary for the ongoing fiscal resilience of the City, and Continue Fiscal Resilience, Fiscal Excellence, and Fiscal Transparency is item #411 on the FY 2023-25 City of San Pablo City Council Priority Workplan adopted May 1, 2024 via Resolution 2023-058, as most recently amended on March 18, 2024 via Resolution 2024-042.

BACKGROUND

After careful consideration of several consulting firms specializing in time impacts analysis, Riedinger Consulting was engaged by the City to provide forensic scheduling consulting services to support the City’s legal defenses against claims brought by Ghilotti Brothers, Inc. related to the Rumrill Complete Streets CIP Project 0700.

On November 15, 2023, City and Riedinger Consulting entered into an Agreement for forensic scheduling consulting services for Phase I services in an amount not to exceed $25,000.  Effective February 15, 2024, City and Riedinger Consulting entered into a First Amendment to that Agreement, adding Phase II services in an amount not to exceed $25,000, for a total compensation under the Agreement as amended not to exceed $50,000.

Staff recommends that the Agreement with Riedinger Consulting be further amended via the proposed a Second Amendment, in a form to be approved by the City Attorney that does not substantially alter the City’s rights or responsibilities from that is set forth in the attached draft agreement, to increase maximum compensation $25,000, for a total compensation not to exceed $75,000, for the provision of additional forensic scheduling analysis in support of the City’s legal defenses, up to and including mediation of claims.

FISCAL IMPACT

The proposed contract amendment under consideration would increase compensation under the existing contract by up to $25,000, for a $75,000 total not-to-exceed amount under the contract as amended, to be funded by the project account (320-0700-43604-GEN-423).
