BACKGROUND

The City Council adopted Ordinance 2004-012, amending Chapter 2.60 of the San Pablo Municipal Code regulating official police towing service.  The City adopted Resolution 2015-180 regulating the maximum standard towing rates and associated fees that can be charged by contracting towing operations.  In conformance with Municipal Code section 2.60.080, the contract for Official Police Towing Service was advertised and bids were accepted.  On November 4, 2015, the bids were opened by the City Clerk’s Office. The following companies were awarded contracts (a sixth company A & D Towing was also awarded a contract but is no longer in business):

Over the last year, there has been an increase in abandoned, wrecked or dismantled recreational vehicles located within the City limits. Currently there are approximately twenty abandoned recreational vehicles within our jurisdiction.

Initially, when the Police Department requested the towing of these vehicles, the tow companies refused to assist due to a lack of storage space and the high cost of dismantling the vehicles.

On March 21, 2019, the Code Enforcement Unit met with the tow companies in order to come to an agreement to tow and dismantle recreational vehicles. The tow companies agreed to tow and dismantle Class A recreational vehicles for a fee of $1,700 each and Class B and C recreational vehicles for a fee of $1,500 each. The fees are consistent with what other jurisdictions are paying within the County.

After towing a recreational vehicle, the contracted tow companies shall invoice the Police Department once there is proof the recreational vehicle has been dismantled. The City shall make payment within 30 days of receipt of an undisputed invoice. 

The recreational vehicles being towed and dismantled must fit the following criteria:

                     Abandonment

                     Safety Hazard

                     Inoperable

 

Staff recommends accepting the amendment to the current tow services agreement and supports the fees for Class A recreational vehicles and Class B and C recreational vehicles.

 

FISCAL IMPACT

The overall fiscal impact is unknown at this time.  Individual tows will cost $1,700 each for class A recreational vehicles and $1,500 each for class B and C recreational vehicles.
