COUNCIL PRIORITY WORKPLAN STATEMENT
This action is not set forth in the FY 2023-25 City Council Priority Workplan, adopted on May 1, 2023; but is necessary and desirable as part of the City's ongoing operations.
BACKGROUND
Chattleton Place Partners, LLC ("Chattleton Place") owns the property located at 2812 Chattleton Lane, San Pablo, CA, which is the site for Chattleton Lane Townhomes. The townhome construction project ("Project") includes the construction of a pocket park, where the City needs access to the irrigation drain line that crosses over the private property. Upon completion of the Project, the City will need an easement ("Easement") to enter onto the private site to access, maintain, and make any future necessary repairs to the irrigation drain line. The Easement provides the City with the right to work, from time to time, to maintain and repair its irrigation drain line within the easement area, as well as rights of ingress and egress over and across the property to perform said functions. The City shall provide Chattleton Place five (5) days' advance notice for maintenance being performed, and is obligated to restore the easement area to its condition before such work was performed.
FISCAL IMPACT
There is no fiscal impact from this item.
